The Public Ministry of the State of Rio de Janeiro (MPRJ) appealed, on Monday (11/10), the decision that acquitted seven defendants accused of arson in Niñho do Ourobo, in February 2019. The incident led to the death of 10 young Flamengo athletes.
The appeal, filed to Criminal Court No. 36, mentions the negligence of the club and the defendants in the case. In addition, there is a request to declare criminal responsibility for defendants whose sentences were dropped. The only case that fits this request is that of former President Eduardo Bandera de Mello.

- Antonio Marcio Mongelli Garutti, Chief Financial Officer (CFO) of Flamingo;
- Marcelo Maya de Sa, civil engineer and deputy director of Flamingo Heritage;
- Claudia Pereira Rodríguez, Administrative and Commercial Director of Novo Horizonte Jacarepaguá, NHJ, responsible for the installation of the containers;
- Danilo da Silva Duarte, production engineer, New Hampshire Operations Directorate;
- Fabio Hilario da Silva, an electrical engineer in New Hampshire;
- Wesley Jimenez, a civil engineer in New Hampshire;
- Edson Coleman da Silva, co-owner of Colman Refrigeração, is responsible for installing air conditioning units in CT.

- Marcos Vinicius Medeirosnight watcher at the residence (summarily acquitted, with decision upheld on appeal);
- Eduardo Carvalho Bandeira de Mellopresident of Flamengo at the time of the containers’ installation (Bandeira was not acquitted, and could have been punished because the deputy’s complaint was time-barred and because of the former leader’s advanced age).
The document was signed by promoter Ana Cristina Fernández Villela and the promoters of the Specialized Action Group for Sports and Fan Defense (Gaedest) and the Specialized Working Group for the Defense of Integrity and Suppression of Tax Evasion (Gaesf).
According to the decision issued by Judge Thiago Fernández de Barros, of the 36th Criminal Court of the Court of Justice, which acquitted the seven defendants in October of this year, the wording of the MP’s complaint was general and contradictory.
A date has not yet been set to consider the MP’s appeal regarding the acquittal of the accused and holding Bandera de Mello responsible.
Remember the case
On 8 February 2019, a fire at Ninho do Ourobo, Flamengo’s training centre, killed ten Rubro Negro youth players and injured three other young men.
According to experts, the situation began in an air conditioning unit and spread quickly due to the lining of the containers in which the athletes were located.
