Former Minister of Justice Anderson Torres On Monday (24), he asked to serve his sentence in the Federal Police Supervision Service (PF) or in a military police battalion. The request has been sent to the Minister Alexandre de Moraesof the Supreme Federal Court (STF).
The former minister’s lawyers say they will file so-called “disagreeable notes” against the 24-year prison sentence in the coup plot. The appeal can be submitted until December 3. According to the defence, if Moraes decides to be arrested before this deadline, Torres must remain in the National Front watchdog, where the former president is located. Jair Bolsonaro (PL) He is being held in pretrial detention, or in a military police battalion of the Federal District.

“If the sentence is to be carried out early, which is accepted by default, it is requested that the compliance be carried out in Federal Police control in the DF or in the Operational Aviation Battalion (BAVOP), or alternatively, in an institution with an equivalent profile appropriate to the functional status of the sentenced person and the minimum requirements for personal security,” the application says. Attorney Omar Novaki is defending Torres.
The motion was filed Monday because the deadline for filing another type of appeal expires today: a clarification ban, which serves to call into question omissions and “ambiguity” in the decision.
It is expected that once this period expires, Moraes will be able to declare the convictions of Torres, Bolsonaro and five other members of the so-called “crucial core” of the coup plot who were convicted by the special court in September, to be final and admissible (when no further appeal is possible).
The dissenting bans, which is the type of appeal Torres and Bolsonaro intend to file, call into question the non-unanimous decisions made by the STF. It turns out that the court’s understanding was that two differences were necessary to accept this type of request, which was not the case in the coup plot convictions. As a result, Moraes likely will not wait until December 3 to announce the final ruling and determine whether or not the sentence will be carried out.
In the application, Torres’s defense claims that there is a risk to the former minister’s physical safety if he is imprisoned in a prison. Lawyers say he has already received death threats. He also held positions as delegate of the Popular Front and Secretary of Public Security in the Federal District.
He added, “The accused, as he is known to the public, was the target of death threats, which were widely published in the press, which at the time led to an enhancement of his personal security.”
