
On Monday (11/10), the Federal Revenue Authority published a memorandum in which it classifies as “unacceptable” the changes made by Federal Representative Guilherme Dirret (PP-SP) in the draft anti-factionalism bill he is authorizing, which is currently being processed in the House of Representatives. According to the agency, the proposed changes could open the way for political interference and weaken the federal government’s role in combating criminal organizations.
According to the memo, the IRS “relies on the independent work of the federal police” to promote actions that seek to dismantle the financing of organized crime.
“The wording presented by the Rapporteur of Law No. 5,582/2025 raises concerns, as the actions of the Federal Police are subject to provocation by the State Governor, leaving room for unacceptable interference and weakening of federal authority, as well as unconstitutionality in light of Article 144, Paragraph 1, I, of the Federal Constitution,” says the Russian Federation.
The Tax Agency also stressed that recent operations against criminal organizations, especially those involving high-level crimes of national scope, should not be subject to authorization by local authorities.
Anti-PL
The original text of the anti-factionalism project, prepared by the government of President Luiz Inácio Lula da Silva, was designed to strengthen the fight against factions, militias and paramilitary groups. However, the changes proposed by the rapporteur have been criticized by various sectors of the government and federal institutions, which claim that the changes are “harmful to the public interest.”
Federal police also issued a memo on Monday, classifying the changes as a “real setback.” The company warned that the restrictions could limit large-scale operations, such as Operation Hidden Carbon, which was launched in August to dismantle a money laundering scheme by the Primeiro Comando da Capital (PCC).

In the face of the negative repercussions, Speaker of the House of Representatives Hugo Motta (Republicans – PB) stated that he organized a dialogue between Dirit and the Director General of the National Front, Andre Rodriguez, to amend the text. According to Mota, the section restricting the duties of the federal police will be changed before the final presentation of the opinion, scheduled for this Tuesday (11/11).
Criticism also came from Palacio do Planalto. Corporate Relations Minister Glycy Hoffman said the changes “take the federal police out of the fight against organized crime,” and described the new text as “a gift to factions operating across the country.”
