
The 28th Criminal Court of the Court of Justice of Rio de Janeiro has just decided that the criminal complaint filed by the Workers’ Party against Jojo Tudinho for slander, insult and defamation should be transferred to one of the criminal courts of the Court of São Paulo.
The dispute began after the artist mentioned in a podcast that she had received an offer of R$1.5 million to support Lula’s campaign in 2022.
In the order of Judge Antonio Alves Cardoso Jr., the judge based his decision on decline of jurisdiction, given that the podcast company, where the interview was published, is located in São Paulo.
“In cases of online defamation, when the location where the offensive content was made available has been identified and, as in the present case, it is not possible to determine when third parties became aware of the crimes (since it is a national platform), the jurisdiction of the place where the offensive content was made available prevails.”
Jojo’s speech was delivered during a podcast produced by Brasil Paralelo, brand name BP Educação e Entretenimento S/A, based in São Paulo. In September, in a conciliatory session, there was no agreement between the singer and the Labor Party.
