
The Court of Justice of São Paulo (TJSP) decided that the City Hall of São Bernardo do Campo, a city located in the metropolitan area, must change the names of places honoring figures and events associated with the military dictatorship, in a judicial decision in favor of a popular measure. The municipality has 180 days to replace the names of Villa Mussolini, Avenida 31 de Marco and Avenida Humberto de Alencar Castelo Branco with names that do not refer to the authoritarian period.
The measure called into question the continuity of the tribute, claiming that it violated the constitutional principles of human dignity and the protection of collective historical memory.
Judge Julio César Medeiros Carneiro, of the First Public Finance Court, understood that public spaces, even of a symbolic nature, can and must be judicially reviewed when they conflict with the fundamental values of the Constitution.
In addition to being forced to change the names, the ruling ordered the city council to pay R$2,000 in legal fees and cover the costs of the operation. The municipal administration has already been ordered to fully comply with the decision.
The popular movement explained that glorifying agents or authoritarian regimes in public spaces can affect collective memory and the educational function of public goods, reinforcing the importance of reviewing street names that indicate periods of repression and violence.

Despite the positive decision, the city council can still appeal. The appeal must be submitted to the Court of Justice of São Paulo within 15 working days after the summons. Until there is a final and non-appealable decision, that is, until the sentence becomes final, the decision can still be modified by the TJSP.
