The 47-year-old woman who was arrested on Sunday (23/11) on charges of racially abusing and physically assaulting a man outside the Beruska bar in Konik was granted temporary release by the Court of Justice (TJDFT) on the same day.

At the hearing, the judge explained that the assailant’s lack of a criminal record meant there was no need to transfer the act to pretrial detention.

The judge classified the incidents as a “one-off incident” that occurred in a specific context. The judge also noted that “although the racist offense is particularly serious and deserving of an appropriate criminal response, the intent of protective custody is not to anticipate a possible sentence of impeachment or guilt.”

According to the judge, the precautionary measures “prove to be sufficient to protect the orderly progress of future criminal proceedings that may be brought against the person being implemented.”
