
Lawyers of former TSE advisor Eduardo Tagliaferro have submitted to the head of the STF, Edson Fachin, a request to suspect Minister Alexandre de Moraes. The defense claims hostility, self-interest and restraint after a request for in-person oral arguments was denied in a trial held in virtual public session.
The petition, which was filed on Sunday (9/11), asks for the immediate suspension of all actions taken by Moraes in this operation. The defense asserts that the minister plays the role of “the accused, the victim, and the judge,” and that the virtual trial that began on November 7 violated the defense’s contradictory and broad rules.

Lawyers Paulo Cesar Rodriguez de Faria and Felipe Rocha de Oliveira say that Moraes maintained the electronic trial even after official opposition from the defense and demanded that the files be redistributed to another minister. The request also refers to complaints made by Tagliaferro in 2024 about alleged irregularities in the conduct of investigations under the Moraes report, which the minister could have refuted on the record.
The STF has the majority to make Tagliaferro a defendant
The first panel of the STF formed a majority to accept the complaint filed by the Public Prosecutor’s Office (PGR) against Tagliaferro.
The accusations against him are of working against the legitimacy of the electoral process and working to undermine investigations into actions such as those that occurred on January 8, 2023.
In the complaint, PGR accuses Tagliaferro of coercion during the operation; Violation of job confidentiality; Obstructing an investigation into a criminal organization and attempting to violently overturn the democratic rule of law.
The trial began, in virtual plenary, on Friday (11/7), with Rapporteur Alexandre de Moraes voting to make Tagliaferro a defendant. Afterwards, Ministers Cristiano Zanin and Flavio Dino followed Moraes’ vote. The trial continues until November 14.
