
Former TSE Chancellor Eduardo Tagliaferro has filed a motion to impeach Minister Alexandre de Moraes (STF) in the Federal Senate. The report, dated November 11, 2025, and signed by lawyer Paulo César Rodríguez de Faria, alleges that the minister acted in operations “in which he was suspected and prevented,” which, according to the document, constitutes a crime of liability.
Tagliaferro states that Moraes is “victim, accused and judge” in the actions involving him. The complainant asserts in the text that the Minister “decided, ex officio, to arrest him and hand him over to the Italian court,” in addition to “issuing the sentence when, according to the law, he is a suspect in the case.”

Judge cites “historic government omission” in declaring Oi bankrupt
One excerpt reads: “Alexandre de Moraes accused of allegations of criminal practices, alleged victim, judge, investigator and accused.”
According to the petition, the minister’s actions violated the constitutional principles of due process, broad defense and judicial impartiality.
The text says: “Impartiality is the basis of jurisdiction. A judge who appears at the same time to be interested in the facts and to judge the accused person violates impartiality and nullifies the essence of the judicial ruling.”
The defense also cites precedents from the STF itself to support the doubt thesis. One of them is HC 164.493/PR, reported by Minister Edson Fachin, which recognizes the loss of a judge’s impartiality.
The document reproduces part of the decision: “The impartiality of the judiciary is enshrined as one of the foundations of ensuring due process. An impartial person is someone who is not a party, and is not bound by the interests of any of the participants in the process.”
In the last clause, Tagliaferro asks the Senate to open a process to remove Moraes from his duties, “to complete the commission of the crime of responsibility,” and states that the minister “was conducting operations of a personal, persecutory and vindictive nature.”
The motion for impeachment has been sent to the President of the Senate, Davi Alcolombre (Uniao Brasil), for reading and eventual processing in accordance with the procedure set forth in the legislation.
The STF has the majority to make Tagliaferro a defendant
The first panel of the STF formed a majority to accept the complaint filed by the Public Prosecutor’s Office (PGR) against Tagliaferro.
The accusations against him are that he is working against the legitimacy of the electoral process and working to undermine investigations into actions such as those that occurred on January 8, 2023.
In the complaint, PGR accuses Tagliaferro of coercion during the operation; Violation of job confidentiality; Obstructing an investigation into a criminal organization and attempting to violently overturn the democratic rule of law.
The trial began, in virtual plenary, on Friday (11/7), with Rapporteur Alexandre de Moraes voting to make Tagliaferro a defendant. Afterwards, Ministers Cristiano Zanin and Flavio Dino followed Moraes’ vote. The trial continues until November 14.
