
In response to a letter sent by State Rep. Renata Souza (PSOL-RJ), the federal agency stated that the containment operation “constitutes an episode of state terrorism, carried out against majority-Black communities.”
The MNPCT reported that, based on legal powers, it had requested complete lists of detained, wounded and missing persons, with name, identity and place of detention or care. It also requested information on prisoners who reported attacks during detention sessions, measures adopted to investigate cases of torture, and procedures to identify missing persons and communicate with their families.
None of the state bodies – including the Prison Administration Secretariat, the Public Ministry, the Public Defender’s Office, and the Civil and Criminal Police – have responded to the messages so far. The omission could constitute an abuse of powers and non-compliance with federal law, the MNPCT warned.
Given the suspicions of executions and abuse of power, the Mechanism recommended that the Public Prosecutor initiate a “jurisdictional shift incident” in the Court of Truth and Justice, so that investigations could be transferred to the federal sphere and ensure “effective investigation and due accountability.”
In the same context, the Commission also informed the Federal Office of the Public Defender, asking it to evaluate the IDC’s recommendation to the PGR.
