The Federal Supreme Court is too dangerous a place to allow diversity. There also the game does not allow the bank owner to take upon himself the duty to observe principles related to the depth of legal knowledge.

Everything indicates that these are the ideas that motivate President Luiz Inacio da Silva (PT) in choosing his nominations for membership of the STF.

The public standard is personal loyalty. As was the case with Jair Bolsonaro (PL), and perhaps as will be in the future, the Presidents of the Republic assume a preferential option for the appointment of defense lawyers to the Supreme Court.

The guarantees of the Constitution are not sufficient and do not matter to them. It is important that everyone adhere to what is in the best interests of the ruler, who, even when out of power, will have a supreme judge appointed by him for as long as possible. Hence the candidates are increasingly younger. You never know what tomorrow holds.

The independence and prestige of the Federal Supreme Court do not matter. The indifference shared by some of the court’s judges, who enter the conflict expressing their preferences as if it were up to them to issue such a ruling.

The right to appoint rests with the executive branch, while analysis is, in theory, the task of the Senate. However, the representatives of these countries are not carrying out their duties satisfactorily. The president chooses from a perspective of subservience and senators design a gesture of submission to the justices through a private forum.

In some cases, as happened with the appointment of Andre Mendonça, and as now with Jorge Mesías, parliamentarians dare to make the Supreme Court a pawn in the political struggle.

Such distortions make the legislature a mere stamp rather than a comprehensive examiner of constitutional rules of impeccable conduct and disreputable legal knowledge.

Saying that the agent’s will is above the law carries with it the possibility that the refusal is a personal crime and evidence of the fragility of the nation’s head. What might be called institutional distortion.
