Opening the “Day of Justice” at the 30th session of the United Nations Climate Change Conference (COP30), Edson Faschin, President of the Supreme Federal Court (STF), said on Thursday (13) that he hopes the conference will provide lessons for a livable future. He also said that there are 350,000 environmental claims being processed in the Amazon region alone, which require the attention of the courts.
“Today we must also move from preaching to accountability. It is a mandatory effort so that we have a livable future without setbacks,” the minister said. “In this event, we propose to build a wide network of cooperation, action and transformation for the benefit of our Pachamama,” he added. The Judges’ Declaration on Climate Change, which should guide judicial work on the subject, will be signed on Thursday by judges from several countries.
Fachin said that the Federal Supreme Court ensured “the provision of effective judicial ruling in the environmental field.” “We were guided by the principles of precaution, climate and the objective responsibility of the state for damage to the climate system,” he said.
He cited recent court decisions to ensure resources for climate action, such as the decision that made any climate fund emergency unconstitutional. “In this ruling and others, the Brazilian Supreme Court has positioned itself as a sensitive actor for the climate agenda and the protection of the environment and indigenous lands,” the presiding judge said.
In his speech, the Minister also referred to the rights of indigenous people. “Indigenous presence and resistance cannot be separated from environmental protection.”
Regarding the prevention and control of fires in the Amazon and Pantanal, he said that the STF had acted by urgently defining fire prevention and control plans.
Finally, the Minister stated that Brazil currently has approximately 350,000 environmental activities being carried out in the Amazon region alone. “Therefore, it is a significant amount that calls for our action, especially regarding issues related to activity that links environmental crimes with major crimes in general,” he said in an interview with TV Justiça.
