The São Paulo Court of Justice (TJSP) has archived the criminal case in which two military police officers (PMs) were investigated for the murder of a man with schizophrenia. What happened
Diener was diagnosed with schizophrenia at the age of 18, and has been undergoing treatment ever since. However, he still had sporadic psychotic episodes, such as that early morning of August 16.
His mother called SAMU and explained that her son was having a schizophrenic episode. The team also asked her to contact the military police to ensure the safety of the rescuers, which was done.
During the outbreak, Diener had a kitchen knife in his hand and a key chain with a pocket knife in his pants pocket. After the unit arrived, he approached the paramedics carrying a bladed weapon, which sparked a reaction from the police.
Soldiers Pedro Henrique and Thiago William shot the man five times. One of the bullets struck a SAMU rescuer in the hand, requiring him to be taken to hospital.
Four other projectiles hit Diner: in the neck, heart area, arm, and back. He died at the scene.

The PMs had a taser and did not use it
Shortly after the murder, a police investigation was launched to investigate the actions of the police and the potential liability of the agents. As a result of the investigation, images from troopers’ body cameras were requested, which revealed that the use of a non-lethal weapon had been a topic of discussion among police shortly before the shooting.
In an audio-recorded conversation, a police officer asks: “You know knife incidents don’t involve stun guns, right?” This statement raised doubts in the State Public Defender’s (DPE) office as to whether there were instructions not to use the equipment, which was not made clear.
Another clip, captured by Private Thiago’s camera, shows a police officer asking: “Are you afraid of the shock, policeman?”
Photos and audio recordings taken by the investigation showed that police officers were carrying a stun gun during the operation that led to Diener’s death. One officer, who did not fire a shot, stated that he had the non-lethal weapon in his hand, but “did not have time to activate it.”

After representation from the MPSP, Judge José Pedro Rebelo Giannini ordered the case closed. The decision was reported to the Diadema Civil Police, which was investigating the case, last Tuesday (18/11).
