Lawyers of former President Jair Bolsonaro (PL), who was detained in pretrial detention by the Federal Police (PF) on Saturday morning (22/11), by order of the Minister of the Supreme Federal Court (STF), Alexandre de Moraes, must explain why he tried to violate the electronic ankle bracelet he has been using since July. Bolsonaro will undergo a custody hearing on Sunday (11/23).
Bolsonaro was arrested at the request of the National Front, which claimed, in an opinion sent to the Supreme Court, that the former president was in danger of fleeing in the face of the vigil called by Senator Flavio Bolsonaro (PL-RJ) in front of his father’s condominium. The report was supported by the Public Prosecutor of the Republic, Paulo Jeunet, in an opinion he submitted in the early hours of Saturday.
In the arrest warrant, Moraes’ order included some specifications: to avoid detection of Planalto’s former boss, who has been under house arrest since August 4, and not to use handcuffs. Federal police investigators carefully followed the judge’s instructions.
Moraes stated in the decision that Bolsonaro attempted to violate the electronic ankle bracelet. In the early afternoon, the minister declassified the video showing the former president confessing to using a soldering iron to burn the device attached to his ankle.
The document compiled by Deputy Director Rita De Cascia, and attached to the video in the case file, shows the former president saying he tried to burn the ankle bracelet out of “curiosity.”
The server explained that at 07:00 a.m., the escort team in front of Bolsonaro’s house received information from the Center for Integrated Electronic Monitoring (Cime) that the device had been tampered with. The team immediately asked Bolsonaro to introduce himself so he could show them the equipment.

The police officers then called the manager, who went to the residence and spoke to Bolsonaro to understand the situation with the ankle bracelet: “Did you use something to burn this here?” Rita asked.
The former president responded: “I put a hot iron in there. Curiosity.” The manager asked: Which iron is hot? “It was a soldering iron,” Bolsonaro said. “I did not break the bracelet (ankle bracelet).”
The former president, as mentioned in a video clip recorded by the director, had been trying to violate the ankle bracelet since late Friday afternoon (11/21). The equipment was replaced shortly afterwards.
Bolsonaro is now without his ankle bracelet – the rapist will undergo a forensic examination – and is being held in a 12-square-metre room in the Federal Police Control Authority, which recently underwent improvements to accommodate him. Despite the decision, the preventive detention imposed by Moraes has nothing to do with the implementation of the 27-year prison sentence as part of the criminal procedure for the coup plot. The process is in the second stage of the request for clarification – which can be submitted by the defense of all defendants until Monday (24/11), until 11:59 p.m.
The decision on Bolsonaro’s preventive detention will be analyzed by First Committee ministers on Monday, in an extraordinary session from 8 a.m. to 8 p.m. The date was set by the Minister of Separation, Minister Flavio Dino.

Humane house arrest
Shortly after the operation, Moraes saw Bolsonaro’s defense request for house arrest on humanitarian grounds as biased. The request was drawn up by the former president’s lawyer on Friday afternoon (11/21), with reports showing his health condition.
The Minister also considered the Defense’s request to allow 16 people to visit him biased – including politicians such as Representatives Sostinis Cavalcante (PL-RJ), Giulia Zanatta (PL-SC) and Pia Cases (PL-DF), as well as Senator Carlos Porteño (PL-RJ). Moraes also canceled all visits that were already scheduled, such as those of governors Ronaldo Caedo (GO) and Tarcisio de Freitas (SP).
