
In a press release published this Tuesday (12/9), the Association of Relatives and Victims of January 8 (Asfav) criticized the bill on dosimetry (PL), which provides for the reduction of the sentences of people convicted of antidemocratic acts in 2023.
The group affirms that the text of the proposal, presented by MP Paulinho da Força (Solidariedade-SP), “is in reality the PL of covalidation of the abuses of the STF, which in no way addresses the heart of the injustices committed. On the contrary, it deals with the progression of the regime and does not modify the sanctions”.
According to family members, the text maintains all the convictions, preserves intact the narrative constructed during the trials and does not guarantee that any of the prisoners will actually be released, nor that the exiles will be able to return to Brazil with legal security.
According to them, it also does not guarantee the cancellation of the million dollar fines, which continue to destroy the assets of families already hard hit by abusive and illegal processes.
“And here is the crucial point: what is the real certainty that the STF, which previously ignored these institutes, will now apply them? None. The text gives to the same body which promoted mass convictions, without adequate individualization and with obvious punitive voluntarism, the prerogative of deciding whether or not there will be a modulation of sentences”, they affirm.
Finally, the association reiterates that the PL does not resolve the legal distortion installed in the country. “This is, in practice, an apparent solution: it creates an impression of progress, when in reality it only reaffirms dependence on a court that has already demonstrated its willingness to ignore fundamental guarantees whenever it suits it. »

Approval of the PL
The plenary of the Chamber of Deputies approved, in the early hours of this Wednesday (10/12), the PL Dosimetry, which recalculates and reduces the sentences of people convicted of crimes in the putschist plot and the acts of January 8, 2023.
Former President Jair Bolsonaro (PL) will also benefit and could see his prison sentence reduced by up to 2 years and 4 months, according to the project’s rapporteur,
Voting opened at 1:38 a.m. The President of the Chamber, Hugo Motta (Republicanos-PB), announced at 2:25 a.m. the result of the vote: 291 votes for and 148 against.
The project will now be analyzed by the Federal Senate. The president of the National Congress, Davi Alcolumbre (UniãoBrasil-AP), declared in plenary session, this Tuesday, that he intends to analyze the PL Dosimetry in 2025.
The approval of Bill No. 2 162/23, known as Dosimetry PL, is a half-victory for Bolsonaro’s opposition, which voted in favor of the proposal, but which until then was trying to articulate a “broad and unrestricted” amnesty for Bolsonaro and the other convicts.

The Dosimetry PL modifies the regime progression rules, a mechanism that allows convicts with good behavior to move to semi-open or open regimes.
The new legislation provides that progression takes place after serving a sixth of the sentence, and no more than a quarter. The change does not apply to cases such as heinous crimes or repeat offenders.
The surrogate also proposes ending the sum of sanctions for crimes against the democratic rule of law, such as attempted coup d’état and violent abolition of the democratic rule of law, which would directly benefit Bolsonaro.
Rapporteur Paulinho da Força also determined that, when these crimes are committed in a “crowd context”, that is to say during a collective act, such as the attacks of January 8, the sentence can be reduced by one third to two thirds. This reduction is only valid if the person did not finance the act or play a leadership role – and would not reach Bolsonaro, designated by the STF as the leader of the coup attempt.
