Federal Deputy Natalia Bonavides (PT-RN) filed with the Chamber an application to the STM (Higher Military Court) so that former President Jair Bolsonaro (PL) and four others found guilty of the coup plot be declared unworthy of official office and lose their ranks.
The nomination is supported by 30 other PT members and includes the same recommendation for former Navy Commander Almir Garnier Santos, former Minister of GSI (Office of Institutional Security) Augusto Heleno, former Minister of Defense Paulo Sérgio Nogueira and former Minister of Civil Home Walter Souza Braga Netto.
They were found guilty by the STF (Federal Supreme Court) for participating in the plot to overturn the result of the 2022 elections.
“The crimes committed by the officers represent a direct attack against the democratic rule of law, involving the use of the military structure for coup purposes and the violation of ethics, discipline and hierarchy,” the parliamentarian asserts. “The STM itself has case law determining loss of rank in much less serious cases, making participation in a coup attempt incompatible with bureaucracy.”
In the statement, the MP claims that with the conviction of the STF, “there is no doubt that these criminal officers not only carried out a plan to overthrow the democratic rule of law, but also used the prestige that at least part of the convicts had among members of the armed forces to motivate the troops to join this coup attempt.”
She says it is “inconceivable” that officers could be convicted of an attempted coup and still retain their ranks.
“The minimum republican expectation incumbent upon the STM is to institutionally dissociate the Armed Forces from the coup d’état, to affirm that military honor is incompatible with any constitutional rupture and to produce jurisprudence capable of preventing future authoritarian adventures,” indicates the text.
