
The National Electric Energy Agency (Aneel) sent a letter to Enel São Paulo demanding explanations for the power outage in 2.2 million properties after strong gusts of wind hit the city of São Paulo and the metropolitan region. Information must be submitted within five days.
In the letter sent this afternoon to the company, Aneel points out that the Civil Defense of São Paulo had already alerted about the forecast of the formation of an “extra tropical cyclone” in Enel’s concession areas.
The Agency also recalls other cases of power outages in Enel concession areas, in 2023 and 2024.
“Considering that the climatic events of November 2023 and October 2024 caused the interruption of 2.1 million and 2.4 million consumption units respectively and that the current event has an impact of a similar magnitude, with more than 2 (two) million consumption units without power supply,” writes director Luiz Fernando Mozna.
With this in mind, Aneel asked the distributor for a detailed description of the meteorological event, such as a description of the emergency plan developed after the Civil Protection alert, the date and time when the company became aware of the cyclone and activated the plan.
The regulatory agency also requested proof that Enel has a structure adapted to the size and complexity of the concession area, which is “capable of responding quickly and effectively to climatic events.”
Enel SP’s current contract ends in 2028, but the company has already requested an early renewal. In the letter this Wednesday, the director of Aneel stressed that the repetition of the company’s failures could lead to the expiration of the concession.
“It is recalled that the constant recurrence and seriousness of failures in the provision of the service constitute non-compliance with contractual clauses and legal and regulatory provisions, which may give rise to the recommendation for expiration of the concession, in accordance with article 20 of ANEEL Normative Resolution nº 846/2019, a situation already formally notified to ENEL SP in TI nº 0049/2024-SFT/ANEEL”, reiterates the agency.
