State Deputy Rodrigo da Silva Bacellar (União-RJ), dismissed from his position as president of the Legislative Assembly of Rio de Janeiro, suspected of having disclosed a federal police operation to former deputy Thiego Raimundo dos Santos Silva, known as TH Jóias, presented a petition to the STF (Supreme Federal Court) claiming that he did not dine with Judge Macário Judice Neto at the day before the parliamentarian’s arrest.
The magistrate was arrested on Tuesday (16) by the PF on suspicion of having disclosed information about the investigation to Bacellar, who is a friend of TH Jóias and who had passed the information to him.
Macário Judice Neto’s defense, however, claims that the leak theory completely collapses given that the meeting did not take place. According to a motion filed with the court, Bacellar was committing a “marital offense” and had falsely told his interlocutor that he was having dinner with the judge.
In the motion, Bacellar’s lawyers say the “claim” that the two had dinner “does not correspond to reality.” The deputy, they continue, “was not in the company of the said magistrate, because he
mentioned his name only in vain.”
In a document sent to STF ministers, lawyer Fernando Fernandes, who defends the magistrate, states that he “was at home packing because he had a trip to Chile the next day” at the time the PF said he was having dinner with Bacellar.
“The Federal Police did not bring a photo of the dinner, the geolocation of the phones, the cars, nothing,” he specifies.
He also specifies that “the judge had no contact with the deputies on the days of the operation and did not find him. The leak did not come from the magistrate.” He added that the deputy “was clearly involved in an extramarital affair and had used the judge’s name.”
