
The leader of the PL in the House, MP Sóstenes Cavalcante (PL-RJ), said on Tuesday that former President Jair Bolsonaro had approved the text of the Dosimetry project, which will be voted on this Tuesday by the House.
Sóstenes also said that an agreement with House Speaker Hugo Motta (Republicanos-PB), and authorized by the former president, would mean that the party’s parliamentarians would not present amendments for a broad amnesty for those convicted on January 8.
The report, presented by MP Paulinho da Força, modifies the Penal Code and the Penal Execution Law, with retroactive effects because it is a more beneficial rule.
— We will not present any amendments, we have reached an agreement with the President of the Chamber, Hugo Motta. We have not yet given up on a broad and unrestricted amnesty, but Jair Bolsonaro has authorized us to move forward in reducing sentences. It was a possible agreement, Bolsonaro agreed to pay his share of the fine in the name of Christmas among these people — said Sóstenes.
Motta confirmed the vote this Tuesday and denied that it was a request from the Centrão leaders who met with Senator Flávio Bolsonaro (PL-RJ) this Monday to discuss the pre-candidacy of the former president’s son for Planalto in 2026.
— This question of amnesty is over. Let’s focus on today. It will not focus on amnesty, but on the possibility of reducing the sentences of those found guilty of the events of January 8. It is natural to arrive at the end of the year with the position of the House. The plenary is sovereign. This decision was taken according to the will of the president, who has the power to set the agenda. It wasn’t at anyone’s request. The material is ripe, says Motta.
Bolsonaro was sentenced to 27 years and three months in prison for attempted coup.
If approved, the text will be submitted to the Senate for further evaluation. At this point, if there are any changes, it comes back to the House for further analysis. If there are no changes, it will be sent to the presidency, during which phase it can be fully sanctioned or subject to vetoes. If sections are blocked, Congress evaluates whether to override the vetoes or maintain them.
The possible reduction of sentences is not automatic either. The defendants’ defenses must request the benefit, which is analyzed by the Court. In the event of a coup plot, the execution of sentences falls under the jurisdiction of the Federal Court (STF).
