The federal deputy Carla Zambelli (PL-SP) submitted this Sunday (14) a letter of formal resignation from its mandate in the Chamber of Deputies. The information was confirmed by the presidential advisor of the House.
“The Chamber of Deputies informs that the deputy Carla Zambelli (PL/SP) communicated today to the General Secretariat of the Council her resignation from her parliamentary mandate”, says the official note.
With the act of resignation, the seat is now occupied by the substitute of the Liberal Party of São Paulo with the greatest number of votes, Adilson Barroso.
In his resignation letter, Zambelli addressed what he called persecution and defended his trajectory. “I affirm: the truth has been told, history has been written and my conscience remains free”concluded the former parliamentarian.
The leader of the PL in the House, Sóstenes Cavalcante (PL-RJ), said that resignation is a common defense strategy aimed at avoiding dismissal. According to Cavalcante, the movement aims to give the deputy “more defense possibilities will be released and will remain in Italy”. The parliamentarian’s defense also indicated that the request contributes to “reduce institutional tensions” in the country.
However, the resignation does not overturn Zambelli’s criminal convictions. The request for resignation, even if it aimed to preserve his political rights to avoid ineligibility, has no effect on the final judicial convictions which already provide for the suspension of his eligibility.
The leader of the PT in the House, Lindbergh Farias (PT-RJ), criticized the resignation, calling it legally ineffective. Farias argued that the act did not have “erase the facts, crimes or effects of the conviction”and warned that the Chamber Council must comply with the decisions of the Federal Court (STF).
The resignation comes shortly after the plenary of the House rejected the revocation of Zambelli’s mandate last Wednesday (10), with 227 votes in favor and 170 against – the revocation required 257 votes.
However, on Friday (12), the First College of the STF unanimously confirmed the decision of Minister Alexandre de Moraes who decreed the automatic loss of the mandate of deputy. Ministers voted Cristiano Zanin, Flávio Dino And Carmen Lucy.
The loss of the mandate was due to the final sentencing of Zambelli to 10 years in prison by the STF for ordering an invasion of the National Council of Justice (CNJ) systems. The conviction, which came unanimously in May, followed the complaint from the Attorney General’s Office (PGR) that the MP had acted with the hacker. Walter Delgatti Neto to insert false documents into the CNJ database, aimed at calling into question the legitimacy of justice and encouraging demonstrations.
Following criminal convictions without the possibility of appeal, Zambelli had his political rights suspended, preventing him from voting or running for office. The MP was also sentenced to 5 years and 3 months in prison for armed persecution of a supporter of President Lula, noted on the eve of the 2022 second round.
