The judiciary accused the president of the Argentine Football Association (AFA) of Claudio Fabian “Chiqui” Tapiaas part of a criminal investigation into a alleged unlawful withholding of pension contributions and social security contributions. The case also reaches board members and analyzes a debt that, according to the control organizations, would exceed 19,000 million pesos.
The accusation was made by the white collar criminal prosecution Claudio Roberto Navas Rialwho presented the request for instructions to the judge Diego Amarante. This is the first formal charge against Tapia in this file, which is still in its early stages but could lead to new procedural measures as evidence continues to be collected.
According to the complaint from the Large Taxpayers Division of the Customs Collection and Control Agency (ARCA), the AFA had made withholdings for the past two years Pension contributions and taxes corresponding to both the company’s own employees and those associated with various Argentine football clubswithout entering the state within the deadlines provided for in criminal tax law.
Authoritarians don’t like that
The practice of professional and critical journalism is a mainstay of democracy. That is why it bothers those who believe that they are the owners of the truth.
The investigation into the AFA is progressing: the DGI will analyze the network of companies that are connected to suspected frontmen
In his opinion, the prosecutor was of the opinion that Tapia should not be investigated only for his role as highest authority of the AFAbut also for his direct responsibility in managing the association’s tax code, a central aspect in the management of tax and pension obligations. For the prosecution, the hierarchical structure of the company and the size of the resources it manages reinforce the hypothesis that the decisions related to the management of the funds could not have been taken outside the central administration.
The court order also emphasizes that, given the economic dimension of the AFA and the size of the amounts analyzed, the investigation should not be limited only to the figure of Tapia. For this reason, the prosecutor considered this pertinent expand the investigation to other board memberswith the understanding that they would have interfered in the management, disposition or control of the resources that are now the subject of the survey.
The debts examined, estimated at more than 19,000 million pesos, correspond to pension and social security obligations accumulated over the last two years. The hypothesis examined by the judiciary aims to determine whether there was a systematic behavior in which contributions were withheld without subsequently being paid to the State, a circumstance which, if proven, could constitute a criminal offense.
The judiciary will deepen the investigation into the companies behind Pilar’s megafarm, which is attributed to Toviggino
The file will now be edited within the file teaching phasein which the judge must evaluate the evidence collected, request new reports and determine the next procedural steps. If the reported facts are confirmed, the case could escalate and lead to criminal liability of the AFA authorities involved, particularly the leadership under Claudio “Chiqui” Tapia.
