
Judge José Firmo Reis Soub, of the 8th Civil Chamber of the Federal District, ordered that the ousted president of Cidadania, Roberto Freire, resume command of the party. The decision, published on Sunday (7/12), is preliminary.
According to the process, Freire was elected president of the party in 2022. At a meeting in 2023, the National Directory decided to change the composition of the National Executive Committee, with the dismissal of four titular members, including Freire. The case was analyzed in the first instance before the DF court, but the request to cancel this meeting was not granted.

In 2nd instance, Judge Soub pointed out that the minutes of the 2023 meeting were not registered at the Notarial Marcelo Ribas Office, of the 1st Civil Registry Office of Brasilia, even two years after the decision.
“Even in summary judgment, the process of changing the board of directors did not comply with mandatory legal procedures. The lack of notarized registration of the election minutes, even after more than two years, corroborates the procedural irregularity reported by the competent registration body,” the magistrate wrote.
Soub ordered the suspension of the effects of the meeting of the National Directory held in 2023, with regard to the election of members of the National Executive Committee and that Roberto João Pereira Freire, “president registered with the Civil Status Office of the 1st Civil Status Office of Brasilia, immediately resume the exercise of the presidency of the Citizenship Party.”
The judge also ordered the sending of a letter to the Superior Electoral Tribunal (TSE) to rectify the records of the composition of the National Executive Commission, according to civil status.
Upon the resumption of the party, Freire will have 30 days to convene an extraordinary meeting of the National Directory to deliberate on the composition of the National Executive Committee, “strictly observing legal norms and statutory procedures, and the minutes of said meeting must be registered at the competent civil registry office”.
