The Club of Rio Grande do Sul suffers a defeat in the 7th Civil Court following a lawsuit filed by a businessman; the action involves a violation of the exclusivity clause in the negotiation

Internacional’s legal department received unpleasant news this Wednesday (17). The 7th Civil Court of Porto Alegre ordered the club to pay millionaire compensation to businessman Jair Peixoto, former representative of players Luan and Valdívia. The amount set by the Court reaches the figure of 28.6 million reais and refers to contractual irregularities in the sale of defender Bruno Fuchs to CSKA, of Russia, carried out in August 2020.
The dispute revolves around an exclusivity clause ignored by the Colorado board of directors at the time of the transaction. Jair Peixoto, through his company Showball, had a document signed by Inter and the athlete which accredits him as the only intermediary authorized to negotiate the transfer of the defender. The contract guaranteed the company the prerogative to represent Colorado in any negotiations involving Fuchs.
However, when CSKA showed interest and completed the purchase of the player, Internacional did not use Showball’s services. In its defense presented during the process, the club claimed that it had not paid the commission precisely because the agent had not actually participated in this specific sale. This argument, however, did not convince the court.
Court orders Internacional to pay 20% of the value
The Court understood that the existence of the exclusivity clause obliged the club to honor its commitment, regardless of who led the final conversations. The sentence condemns Inter to pay 20% of the total value of the agreement concluded with the Russians. The jump to BRL 28.6 million is due to the application of interest, monetary corrections accumulated since 2020, in addition to the payment of legal fees and procedural costs.
Contacted for comment on the defeat in court, Internacional took a discreet stance. The club has limited itself to informing that it considers the process to be “old” and that it will not comment publicly on the court decision for the moment. While the board of directors evaluates possible resources, Bruno Fuchs continues his career far from Beira-Rio. The defender, Olympic champion, currently defends the colors of Palmeiras. This conviction represents a blow to the treasury of Colorado, which is already facing the usual budgetary challenges of Brazilian football.
