The defense of Jair Bolsonaro (PL) again requested, this Monday (15), from the Minister of Alexandre de Moraes, of the STF (Supreme Federal Court), authorization for the former president to undergo emergency surgery.
According to lawyers, he needs bilateral surgery for inguinal herniorrhaphy, in addition to additional procedures.
The former president has been detained at the Federal Police Superintendency since November 22. He was convicted by the STF as part of the coup process.
Moraes authorized on Friday (12) that Bolsonaro receive a doctor to perform an ultrasound. The day before, he also ordered the federal police to carry out a medical examination within 15 days to assess the need for surgical intervention.
“It appears that since the defense’s last statement, there has been an objective and proven evolution of the clinical picture, now supported by a recently performed imaging examination and a new conclusive medical report, which requires immediate action,” the lawyers said.
The report presented by the team also states that the symptoms of pain and discomfort in the inguinal region intensified due to frequent hiccups.
These attacks also “cause an intermittent increase in abdominal pressure, significantly increasing the risk of intestinal incarceration or strangulation – hypotheses that, if realized, would require emergency surgery, with exponentially higher risks.”
“In this scenario, we are not faced with a distant or abstract preventive hypothesis, but with a current, objective and proven medical need, the postponement of which exposes the petitioner to a real risk of sudden deterioration, emergency hospitalization and possible avoidable surgical complications,” they said.
Lawyers Celso Vilardi, Paulo Cunha Bueno and Daniel Tesser also stated that it was essential to carry out the intervention in a planned manner, in a suitable hospital environment, with postoperative monitoring and motor physiotherapy.
The defense of the former president requested on Tuesday (9) permission to leave the superintendency and said that Bolsonaro had to undergo a procedure “both to treat the hiccups, a consequence of the surgical interventions already recorded in the present case, and due to the worsening of the diagnosis of unilateral inguinal hernia, which also indicates the need for surgical intervention.”
The defense also reiterated its request for humanitarian house arrest.
Before the episode, the defense had already added to the trial several documents and examinations listing Bolsonaro’s health problems and spoke of a “risk to the life” of the former president. They asked that the politician be kept at home, where he had been under house arrest since August 4.
According to the medical reports attached to the defense request, these surgical interventions would require immediate hospitalization lasting 5 to 7 days.

In the petition to the Supreme Court, the lawyers claim that the health of Bolsonaro, who suffers from hiccups, is “profoundly weakened” and mention that he has been hospitalized three times since his house arrest was ordered.
The former president is said to suffer from serious illnesses of several kinds: cardiological, pulmonary, gastrointestinal, neurological and oncological – he was diagnosed with skin cancer. Therefore, they say, there is a need for supervision at all times, something the prison system cannot provide.
