
The Ministry of Labor and Employment (MTE) has released the resources of the Service Time Guarantee Fund (FGTS) which were withheld for those who registered for the anniversary withdrawal and who were dismissed without valid reason and whose balance was blocked.
The Provisional Measure (MP) was published this Tuesday (23/12). The first payment, of up to R$1,800, will be paid on December 30. The second installment will be paid on February 12.
The measure will benefit approximately 14.1 million workers and inject 7.8 billion reais into the economy between the end of 2025 and the beginning of 2026. The ministry’s authorization also aims to allow workers to move the account balance linked to the terminated contract, even those who opted for this modality in 2019.

FGTS anniversary withdrawal: what it looks like today and what it will look like
The proposal had already been anticipated by the Minister of Labor, Luiz Marinho, at the end of November.
On this occasion, he declared that he would present to President Luiz Inácio Lula da Silva (PT) the suggestion of a new release of the sums withheld from the FGTS for workers who, after being dismissed, were not able to withdraw the balance because they had opted for the anniversary withdrawal.
Understanding the anniversary withdrawal:
- The FGTS birthday withdrawal is a method which allows workers to withdraw, annually, part of the balance of their accounts linked to the Fund, during the month of their birthday.
- By opting for this modality, the worker loses the right to withdraw the entire balance in the event of unfair dismissal, only retaining the right to a 40% dismissal fine.
- The amount released for withdrawal is calculated on the basis of a rate on the total balance, increased by an additional fixed due date, which varies depending on the amount available.
