After the veto used by President Luiz Inacio Lula da Silva was overturned last Thursday (12/4), by the National Congress, retaining the requirements for toxicity tests for categories A (motorcycles) and B (passenger cars), many doubts about the measure have invaded the Internet. After all, this is completely new for those getting their first license.

A negative test was previously only required for Categories C, D and E, meaning drivers driving buses, minibuses, vans and school transport vehicles. Now, the same testing rules apply to all categories of the national driver’s license.

  • What type of toxicology test is required?

According to data from the National Traffic Secretariat (Senatran), the toxicology test required to obtain a driver’s license is one with a wide detection window, with the aim of checking the consumption of psychoactive substances, whether active or not, up to 90 days before the procedure.

  • How is this exam performed?

Toxicology screening is performed with a wide detection window using a keratin sample, which may be hair and/or fur. In the absence of these elements, it can be performed using nails, but only with a dermatologist’s report confirming alopecia universalis. The aspiring driver can choose where the samples will be taken.

  • Why hair and nails?

Urine and blood tests have a detection window of only a few days. On the other hand, hair strands and body hair provide a long and detailed history of drug use.

  • Where can I do this procedure?

Toxicity tests are performed only by laboratories approved by Senatran. They, in turn, rent laboratory collection stations (PCL), which will be responsible for collecting samples. Check the list of eligible laboratories here.

  • How much does toxicology cost?

The Brazilian Traffic Law (CTB) prohibits public bodies from setting prices for planned tests, so prices are determined by free competition.

  • Does it have an expiration date?

Yes, up to 90 days from the date of collection and can be used for other purposes.

  • What if I take psychoactive substances due to medical treatment?

Once the consumption of this type of substance is discovered, it is necessary to prove the use under a medical prescription, and in this way the right to license, renewal and change between categories is guaranteed.

  • Is it possible to request an appeal and administrative appeal?

Citizens are guaranteed the right to counter-evidence and administrative appeal, which must be submitted directly to the responsible laboratory. A surveillance test is performed using the original sample, rather than by another laboratory and/or a new biological sample. In general, laboratories take two samples to guarantee the result.

Voting in Congress

The vote to resume mandatory screening in the project was significant: 417 votes in the Assembly and 72 in the Senate.

The law was actually authored by the executive branch itself, but the section regarding toxicology tests for drivers who will not work on professional transportation was included in the form of an amendment by senators.

When vetoing the listing, President Lula justified that the measure was “contrary to the public interest, as it would lead to increased costs for society and could encourage the driving of vehicles by unlicensed persons, which would jeopardize road safety.”

While discussing the matter, deputies estimated that the probation requirement would mean that whoever obtains the first license would have to pay between R$110 and R$250 extra in the process.

The law also allows physical and mental health clinics to operate as examination collection points. The text also allows for the use of resources collected from traffic fines to fund training for low-income drivers (CNH Social).
