The Minister of the STF (Supreme Federal Court) Gilmar Mendes withdrew from the decision which established that only the PGR (Attorney General’s Office) could present an impeachment request against the ministers of the Court.
He responded to a call from the Senate that questioned the injunction granted as part of an action by the Solidariedade party and the AMB (Association of Brazilian Magistrates) that called for changes in the handling of impeachment requests.
The injunction remains in force for all other matters. In another change, the minister withdrew the measure from the virtual plenary of the Court. It will now be voted on in person.
They establish that impeachment proceedings against magistrates can only be opened with a 2/3 vote of the Senate.
Today, with a simple majority of those present, respecting the quorum of 41 parliamentarians present at the session, it is possible to open the action.
