
President Gustavo Petro gave the green light for the extradition of Andrés Felipe Marín Silva, alias Pipe Tuluá, to the United States. The accused criminal is the leader of the criminal organization La Inmaculada, with which the national government wants to promote peace dialogues in order to put an end to the violence carried out by the illegal group.
“Grant the extradition of Colombian citizen Andrés Felipe Marín Silvaidentified with the citizen card number (…) to appear in court before the authorities of the United States of America,” says the document signed by the head of state.

Alias Pipe Tuluá must answer for three crimes with which he was accused in the indictment filed against him in Case No. 4:24-CR-195 SDJ/BD, filed September 11, 2024 in the United States District Court for the Eastern District of Texas:
- Concert to distribute and possess with intent to distribute cocaine.
- Agreement to traffic and distribute cocaine with the intent, knowledge, and reason to believe that the cocaine would be lawfully imported into the United States.
- Manufacture and distribution of five kilograms or more of cocaine with intent, knowledge and reasonable belief that cocaine would be unlawfully imported into the United States.

The document also orders that the extradition of the alias Pipe Tuluá should not be postponed due to other criminal proceedings or convictions against him. Likewise, the United States is urged to authorize the repatriation of the said criminal to Colombia once he has served his final sentence.
“Ordering the transfer of the Colombian citizen Andrés Felipe Marin Silva to the requesting State, under the obligation that he fulfills the conditions set out in Article 494 paragraph 2 of Law 906 of 2004, i.e The wanted citizen must not be subjected to enforced disappearance, torture or cruel, inhuman or degrading treatment or punishment.“, he explains.
An appeal can be lodged against this decision, which must be lodged in writing during the proceedings or within 10 days of the announcement of the extradition permit.

The Supreme Court endorsed Marín Silva’s extradition in a November 2025 decision. He pointed out that if the national government authorizes the extradition of the accused – which it has already done – it must guarantee his stay in the country requesting the extradition and that, in the event of his acquittal and repatriation to Colombia, he will be treated with dignity and respect, even if he serves the sentence imposed on him and then returns to the national territory.
He also warned the government about it must request that alias Pipe Tuluá be charged only with the crimes for which he was requested to be extradited and which were committed after December 17, 1997. Furthermore, it must be ensured that the perpetrator is not tortured or punished with the death penalty, life imprisonment or exile.
“The fact that there are execution convictions against Andrés Felipe Marín Silva on facts other than those of the foreign accusation is not a circumstance that prevents the court from giving a positive extradition judgment in a case such as the present The constitutional and legal requirements for issuing a decision in this regard are fully met.“, explained the court at the time.

After the court approved his extradition, “Pipe Tuluá” released a statement asking for calm in the municipality of Tuluá (Valle del Cauca). In addition, he denied the allegations against him related to drug trafficking and assured that the allegations against him were due to his being detained in the extradition pavilion of La Picota prison.
“I remain firm in my proposal to seek a political solution to the conflict and in my position that I am not a drug trafficker.“, he claimed.
