
The Copyright Commission Indecopi imposed sanctions on a Peruvian company for importing bubble toys that reproduced the artistic work Peppa Pig without the permission of the rights holder. The procedure was initiated following a complaint from Hasbro Consumer Products Licensing Limited, which warned against the importation of bubble toys that graphically replicated the character Peppa Pig without authority. According to the files, the goods were discovered during customs inspection operations after Sunat issued an alert warning of possible infringement of intellectual property rights.
The complaint allowed the Copyright Commission Evaluation of customs documents, test reports and technical information related to import. The Commission verified whether the characteristics, quantities and descriptions of the toys matched those contained in customs documents and in tax authority reports. In order to determine the fine, the Indecopi applied the methodology established in Supreme Decree No. 032-2021-PCM, which regulates the gradation of fines in administrative sanction proceedings. This methodology includes estimating a base sentence, assessing aggravating or mitigating factors, and making final adjustments in accordance with applicable legal limits.
In this case the Commission used the ad hoc method and took the CIF value of the imported products as a reference. The estimated illegal benefit from the illicit importation of the toys amounted to S/2,270.35. From this amount and taking into account a probability of detection classified as medium, a basic penalty of 14,296.91 S/ was set.
When examining the aggravating and mitigating circumstances, the authority found that the company was acting for profit, given the volume of imported products and their obvious marketing purpose. This element was considered a relevant aggravating factor that increased the… fine Base: 50%.
Since no mitigating circumstances were identified, the final applied factor increased the provisional fine to S/21,445.37, accordingly 4.01 ITU. The Commission found that this amount did not exceed the maximum limit provided for by the Copyright Act and therefore confirmed the economic penalty as the final fine.
In addition to the fine, the Indecopi ordered the final confiscation 13,355 toys confiscated Bubbler. In application of Article 178 of Legislative Decree 822, it was ordered that these goods be delivered to Hasbro Consumer Products Licensing Limited in its capacity as owner of the rights infringed.
