
The Ministry of Labor and the CC OO and UGT unions have agreed to extend the death permit for up to ten days, instead of the current four days. The project does not have the support of the employer, who comes expressing his rejection of the proposal, agreed this month by the central offices and the department of Yolanda Díaz.
To become law, the pact must be approved by Parliament. The Secretary of State for Labor, Joaquín Pérez Rey, asked the groups to position themselves in favor of the modification, which includes the creation of a palliative care permit (15 days) and other euthanasia aid (for one day). The day of death of a family member, according to the ministry, could be spread over four weeks from the day of death.
Pérez Rey described the current situation of this type of authorization: “Now the death of a child is a matter of two days. The fact that a family member dies in a hospital is not recognized as one of the situations giving rise to the possibility of absence. If a person is designated to accompany someone through their euthanasia, they may also be absent from work. » He estimated that with this agreement with the unions, Spain would take “a giant step towards becoming a more civilized country in terms of labor rights”.
Many of those in the ministry who led the negotiations said that labor relations “must also be human” and that “the majority of entrepreneurs believe in it.” He then criticized the employer for not being part of the agreement, an opposition known since last week, once the ministry decided to continue the negotiation without CEOE and Cepyme for its rejection of the Work project.
“We cannot accept the ministerial proposal regarding authorizations for anyone at its extremes,” the employers said in a statement, after this last meeting in which they participated. According to him, this dialogue “was at no time discussed at the negotiating table” and considers that “the meetings held are the result of the questions raised by the representation of companies behind the surprise announcement on the sidelines of the social dialogue, a discontent that appeared after the unions”. At the same time, he said he “regretted” that Labor “decided to put an end to these tripartite consultations”.
Pérez Rey called it “a shame” that the employer does not participate in this pact of reciprocal permissions. “It’s incomprehensible. They must decide why they exclude themselves from regulations that bring our country into modernity. This should have been agreed upon by everyone,” added the Secretary of State for Labor.
On the union side, the UGT representative asked for “decorum”, “coherence” and “sensitivity” from the parliamentary groups. “We must recognize that it is a necessity because it goes beyond all workers, including them,” says Patricia Ruiz, before describing the current regulations as “miserable”. CC OO negotiator Javier Pacheco, along the same lines, asked the representatives not to resort to “technicalisms” to reject a standard “full of humanity”. “It is necessary to pay enough attention to the most difficult moments that a person experiences in the exercise of their life,” Pacheco said.
The unions and the ministry agreed to modify the status of workers, so as to extend the death permit and to create both euthanasia and palliative care. The last modification of the Statute proposed by the ministry to Congress was a reduction in working hours, rejected by PP, Vox and Junts. Workers and unions hope that the success of this regulation will be different and that, given the sensitivity of the subject, only parliamentarians will support it. However, PP and Junts rejected government agreements that did not have the approval of professional organizations.
The work proposal
The ministry and the unions have not yet distributed the agreed text, but Subrayan is only modifying the proposal made by the ministry at the start of the negotiations. Pacheco cataloged the changes as “technical aspects” to “put an end to a certain confusion, to make life easier for the judicial system, which is very user-friendly in establishing interpretations.”
The text modifies article 37 of the Statute, which regulates weekly rest, leave and authorizations. He proposes a new article which establishes “a few days favorable to a duel in the event of the death of the spouse, the hecho couple or the parents up to the second degree of consanguinity”. This second degree of consanguinity implies that these days apply to the decision of fathers, sons, brothers, aggressors and grandchildren. The authorization maintains the time limit provided by the regulations for deaths up to the degree of affinity. It is decided, before the workers die, that we or others will keep the extended furlough days if the worker has to move. The worker can share these days as taken into account more than 28 days later.
The proposal also grants up to 15 days for the care of spouses, couples or relatives up to the second degree by consanguinity, who need palliative care. “The exercise of the right to these days can be divided, the volunteering of the worker, into two fractions, over a period of three months, from the first day on which the worker takes refuge in this authorization and until the end of the death of the person who needs this care,” adds Trabajo.
In fact, the Díaz department proposes a new authorization to accompany a euthanized person: “The day in which the self-administration or practice is carried out by the health professional, whenever the person working has been designated by that person to accompany him or her at that time.”
The Work proposal also extends the hypotheses in which the worker will be entitled to a reduction in working time due to care. At this stage you can take care of anyone under the age of 12, family members up to the second degree of consanguinity or affinity of a disabled person, with the possibility of reduction of up to half a day with a proportional reduction in salary. “The same right will be granted to any person who must take care of their partner, or a member of their family up to the second degree of consanguinity, who needs palliative care, both in hospital and at home,” specifies the text that Trabajo transferred to social agents.
