
In a signal from Minister Jorge Messias to the Senate, the Attorney General’s Office (AGU) submitted on Wednesday (3/12) a statement asking Gilmar Méndez to reconsider the decision that restricted requests for the dismissal of STF ministers.
In its opinion, the African Union requests that the Minister himself reconsider the precautionary measure and suspend its effects until the final ruling on the measures is issued by the plenary session of the Supreme Court. The topic is on the agenda of the virtual plenary session that begins on December 12.
Gilmar had requested a statement from the African Union on this matter in September. Since Messias was already included in the STF at the time, the department ended up not commenting on the matter. In his decision, the STF Minister pointed out the absence of a statement from the authority.
“The union prosecutor (sic) has not submitted his statement either,” the current Dean of the Supreme Court wrote on page seven of his decision.

However, Gilmar’s order forced the AGU to speak out publicly, putting senators at risk of using the department’s omissions on the issue to make life more difficult for Messias, who is counting on the Senate to approve his nomination to the Supreme Court.
