Arrested in the second phase of Operation Nail and Flesh, federal judge Macário Ramos Júdice Neto, of the Federal Regional Court of the 2nd Region (TRF-2), was dismissed from his position on the night of Wednesday (16/12).
The dismissal was decided by the Minister of STJ, Mauro Campbell, and national inspector of justice. In the decision, he highlights the risk that the judge will tarnish the image of the judiciary if he remains in office.

“From this point of view, it must be considered a conduct of great seriousness, to authorize the preventive removal, not only of those which can still be practiced, in a situation of continuous infringement or compromise of jurisdictional activities, but also of those which, once carried out, actually had the potential to tarnish the image of the Judicial Power and the confidence placed in it by the jurisdiction,” said the Minister of STJ in the confidential decision, to which the chronicle had access.
Macário was arrested on suspicion of leaking information regarding Operation Zargun to State Deputy Thiego Raimundo dos Santos Silva, TH Joias. The judge was rapporteur of the action against the parliamentarian.
The investigation highlights that the judge was with the president of the Legislative Assembly of Rio, Rodrigo Bacellar (União Brasil), when the deputy called TH Joias to inform him of the operation.

This is not the first time Macário has been removed from office. He was away for 18 years and only returned two years ago. The first dismissal of the judge was determined by TRF-2 in 2005.
At the time, the magistrate was dismissed from his post after being targeted by criminal proceedings targeting his alleged participation in a system of selling sentences linked to the slot machine mafia.
Macário was acquitted in 2015, but nevertheless remained out of court due to an administrative disciplinary procedure (ADP) on the same subject.
