
Federal judge Macário Ramos Judice Neto acknowledged that there was a leak from a police operation that affected Rio de Janeiro state deputy Thiego Raimundo dos Santos Silva, known as TH Jóias, but he placed responsibility on the federal and civil police, not the federal judiciary.
The statement appears in a decision by Minister Alexandre de Moraes, of the Supreme Federal Court (STF), who ordered the preventive detention of the magistrate precisely for having disclosed the aforementioned operation.
In the representation, the PF highlighted that during a session of the Federal Regional Court of the 2nd Region, on September 8, a few days after the operation against TH Jóias, Macário spoke about the leak.
“Why didn’t they seize money and weapons? Because there was a leak. The operation was disclosed. And it’s not in the Federal Court. I was against the execution of the warrants with the civil police. (…) I was absolutely against it and I warned the commissioner: ‘Don’t do this operation together. And they did it. And they had difficulty stopping the TH, because the operation was disclosed,’ he said.
According to Moraes, the statement “corroborates the evidence of criminal activity” of the judge in order to protect “the members of the criminal organization, with the aim of protecting the political members of the criminal structure from the investigative actions of the Federal Police.”
The decision also mentions a close relationship between the judge and Rodrigo Bacellar, then president of the Legislative Assembly of Rio de Janeiro (Alerj). According to the document, during the same period that Bacellar and the judge were together, TH Joias exchanged messages with Bacellar about the impending police operation. For the Federal Police, the dialogues indicate that TH Joias had prior access to confidential information.
According to the decision, the police authority concluded that the relationship between Bacellar and Judice Neto had a “significant impact on the continuation of investigations”, highlighting signs of obstruction of justice and violation of functional secrecy.
