
The plenary assembly of the Constitutional Court refused to suspend the challenge of Oriol Junqueras, Jordi Turull, Raül Romeva and Dolors Bassa, convicted in the case of process and to whom the Supreme Court decided not to apply the amnesty law regarding the offense of embezzlement. The Constitutional Court, which will rule in the coming months on the merits of the appeal for protection presented by the four against the decision of the Supreme Court, considers that deciding now on the suspension of ineligibility would mean advancing the decision on protection, and that there is no reason of urgency that justifies it, according to the three orders approved.
The four independence leaders were sentenced, for the offense of embezzlement, to sentences of more than 12 years of ineligibility for their participation in the independence process which resulted in the unconstitutional referendum of October 1, 2017 and the declaration of independence which followed. After the approval of the amnesty law, the Supreme Court decided not to apply it to the crime of embezzlement and upheld the disqualification, which is why the four appealed for protection. In addition, they asked the Constitutional Court to temporarily suspend the forfeiture before ruling on the merits of the appeal, which the Guarantee Court rejected today in three orders signed by José María Macías, César Tolosa and Cándido Conde-Pumpido.
