
The Minister of the Supreme Federal Court (STF) Alexandre de Moraes rejected, Friday (5/12), the slides that would be used by the defense of Filipe Martins, former advisor for International Affairs to Jair Bolsonaro (PL), during the trial of core 2 of the coup attempt, scheduled for next Tuesday (9/12).
Martins’ lawyers were informed of the decision this Saturday (12/06). In a note released to the press, the defense claims that Moraes’ decision constitutes “undue protection of the legal profession.” The lawyers said they would appeal to the Brazilian Bar Association (OAB) and refile the cases.
“Moraes requested in advance the slides that will be used in the oral argument, to ‘verify technical adequacy,’ but he really wanted to assess what will be presented in the oral argument before the day, thus exercising undue protection of the legal profession,” the defense said.
Moraes considered the material “partially impertinent”. He claimed it contained “several documents and images which are not included in the file and do not relate to the subject matter” of the process.
The minister, on the other hand, considered the audiovisual documents sent by the defenses of other defendants, such as Mário Fernandes and Marília Ferreira de Alencar, to be relevant and authorized their use.
The decision is not a ban. Moraes determined that Martins’ defense had until 3 p.m. Monday (12/8) to present new “legally adequate” evidence.
