
“The modus operandi of the criminal organization condemned by the Federal Court indicates the possibility of planning and executing escapes outside the national territory, as the accused Alexandre Ramagem did, including with the help of third parties,” states the Moraes decision, signed this Friday.
In the order, Moraes said the defendants’ standard of action demonstrates a concrete risk to the enforcement of criminal law. He cited the examples of the former director of the Federal Highway Police, Silvinei Vasques, and the former director of Abin Alexandre Ramagem. The first was arrested at Asunción International Airport while trying to board a flight to El Salvador. The second managed to escape by crossing the border between Brazil and Guyana and is now free in the United States.
“The end of the trial on the merits of this criminal action and the well-founded fear of seeing the accused escape, as has happened several times in similar situations during convictions referring to 1/8/2023, authorize the decree of preventive detention to effectively guarantee the application of criminal law and the sentencing decision of this Federal Supreme Court,” wrote Minister STF.
Moraes also considered that he had the necessary elements to order preventive detention, but did not do so because he considered house arrest more “appropriate and proportionate”.
The judicial decisions issued by Moraes were respected in the states of Rio de Janeiro, São Paulo, Espírito Santo, Paraná, Goiás, Bahia, Tocantins and in the Federal District, with the support of the Brazilian army in part of these efforts.
In addition to house arrest, the minister imposed precautionary measures, such as the use of electronic ankle bracelets, the ban on visits and the use of social networks, the issuance of passports and the suspension of firearms possession documents.
Until this Saturday morning, the PF executed arrest warrants against the following targets:
- Filipe Martins (PR), former advisor to the president of the Bolsonaro government
- Giancarlo Gomes Rodrigues (BA), army adjutant
- Marilia Ferreira de Alencar (DF), former director of intelligence at the Ministry of Justice
- Angelo Martins Denicoli (ES), army major
- Fabricio Moreira de Bastos (TO), army colonel
- Sergio Ricardo Cavaliere (RJ), army lieutenant colonel
- Bernardo Romão Correa Netto (DF), army colonel
- Ailton Gonçalves Moraes Barros (RJ), former army major
Two targets were not found at their addresses. They are the president of the Voto Legal Institute, Carlos Rocha, and Lieutenant Colonel Guilherme Marques Almeida.
The targets were sentenced in the last two months by the first college of the STF to sentences ranging from 7 to 21 years in prison for the crimes of attempted violent abolition of the democratic rule of law, armed criminal organization, coup d’état, among others.
