This Thursday 11/12, around 2 p.m., the leader of the PT in the Federal Chamber, MP Lindbergh Farias (RJ), filed an appeal for mandamus with the Federal Supreme Court (STF) against the decision of the Chamber rendered in the early hours of today and which maintained the mandate of Carla Zambelli (PL-SP).
In the request addressed to Minister Alexandre de Moraes, the PT leader requested an injunction for the STF to force the Board of Directors of the Chamber to immediately comply with the court decisions that determined the loss of the mandate of Carla Zambelli (PL-SP).

“It is absurd that the Chamber has a bench of deputies on the run, three deputies. It was absurd that Eduardo Bolsonaro was acquitted by the Ethics Council, it was absurd that the plenary held Zambelli’s mandate yesterday. But the mistake was made by the President of the Chamber, Hugo Motta.”
“President Hugo Motta had an obligation to comply with the court ruling. By failing to do so and even putting the matter to a political vote, he is creating an unnecessary crisis and exposing himself to the possibility of being held liable for a criminal offense.”
About 40 minutes ago, Lindbergh wrote on X:
“The decision has just been taken to note that the loss of the mandate is automatic, that the deliberation of the Plenary is void and that the Chamber immediately complies with the Constitution”
“The minister recognized that the final sentence of Zambelli to 10 years in prison in a closed initial regime makes it legally impossible to exercise the mandate, imposing the automatic loss provided for in Article 55, paragraph 3, of the Constitution, the Council being only responsible for declaring the act, without submitting it to the Plenary”
The STF decision affirms that the Chamber completely violated the Constitution by preserving the mandate of Carla Zambelli, producing a null act for abuse of purpose, illegality and affront to the constitutional text, since the STF itself had decreed the loss of the mandate in AP 2.428/DF.

Minister Moraes restored the authority of the Court and ordered the immediate execution of the final decision, emphasizing that the plenary of the Chamber cannot revise, relativize or ignore the automatic effect resulting from a criminal conviction.
The minister also ordered the Speaker of the House to take up his duties as substitute within 48 hours, in accordance with art. 241 of the Internal Regulations, guaranteeing the full execution of the court decision.
It is a victory for the rule of law, the separation of powers and respect for the final decisions of the Federal Court. We will remain vigilant so that no authority violates the Constitution through casuistry or regimental maneuvers.
