Moraes denies use of slides by Filipe Martins defense in STF coup trial

BRASILIA – Minister Alexandre de Moraes, of Federal Court (STF)rejected the slide presentation that the defense of the former advisor to former president Jair Bolsonaro (PL) Philippe Martins would use in pleading Tuesday 9, in his trial and other members of the so-called “core 2” who allegedly attempted a coup in Brazil.

According to the minister’s order, the documents presented by Martins’ defense contained documents and images unrelated to the criminal action analyzed. Moraes, however, disclosed the elements of the accused Fernando de Sousa Oliveira, Mário Fernandes and Marília Ferreira de Alencar, which were considered “relevant”.

“The audiovisual documents sent by the Defense of Fernando de Sousa Oliveira, Mário Fernandes and Marília Ferreira de Alencar, are relevant and pertinent, unlike the material presented by the Defense of Filipe Garcia Martins Pereira, which is partially impertinent, composed of several documents and images that are not included in the file and do not relate to the subject of this Criminal Action 2.693/DF, nor with the defensive theses presented in the allegations finals,” Moraes said.

Defense will lead the OAB

For Martins’ lawyers, on the contrary, the documents brought together “excerpts from the files, decisions already rendered and points debated throughout the investigation, functioning as a visual summary of the evidence and theses gathered in the final pleadings”.

According to the defense, the slides summarized the content and would serve to organize exposition during the trial.

“Moraes requested in advance the slides that will be used in the oral argument, to ‘verify their technical adequacy,’ but he really wanted to assess before the day what will be presented in the oral argument, thus exercising undue protection of the legal profession,” they said in a memo.

The defense intends to exercise its functions with the Brazilian Bar Association (OAB) and re-file the slides, “now with an express indication of the references of each document, image and video in the file.”

“Alexandre de Moraes is trying to say what the defense can or cannot present in defense of his client,” the lawyers said.

Defenders also say the minister did not specify which articles would be impertinent.

“All the content contained in the slides is in the minutes, it was the subject of debates and even decisions by the minister himself. With this decision, Moraes admits that he ignores the minutes and wants to protect the defense,” they argued.
