Minister Alexandre de Moraes, of the Supreme Federal Court (STF), annulled the decision of the Chamber of Deputies which rejected the dismissal of MP Carla Zambelli. Thus, this Thursday the 11th, Moraes notes the loss of Zambelli’s mandate and gives the deputy 48 hours to take office in the Chamber.
“The deliberation of the Chamber of Deputies, which rejected the loss of the parliamentary mandate of CARLA ZAMBELLI SALGADO DE OLIVEIRA, occurred in flagrant violation of Article 55, III and VI, of the Federal Constitution (“Art. 55. The deputy or senator will lose his mandate; FEDERAL COURT, and became definitive on 6/7/2025 according to a certificate prepared by the Secretariat Judiciary of this SUPREME COURT,” Moraes said in the decision.
The House rejected Zambelli’s impeachment in a plenary vote in the early hours of Thursday. There were 227 votes for dismissal, 170 votes against and ten abstentions. As at least 257 votes were needed for her to lose her mandate, the impeachment procedure was theoretically rejected. And all this happened after the Committee on the Constitution and Justice (CCJ) of the House of Representatives approved the revocation the day before – in accordance with the Supreme Court’s decision.
Carla Zambelli was arrested in July this year in Italy while on the run. She was sentenced to ten years in prison and the loss of her mandate for her involvement in the computer invasion of the National Council of Justice (CNJ) system.
