The judge stressed that the totality of the evidence does not establish a direct link between the mother’s behavior and the fatal outcome, although the prosecution said Carla failed to provide basic care.
The Rio Grande do Sul court decided this Wednesday (10) that Carla Carolina Abreu Souza, mother of 9-year-old Kerollyn Souza Ferreira, will not be tried in jury court for the murder of her daughter. The young girl was found dead in a trash can in August 2024, in Guaíba. The decision of the 1st Municipal Criminal Court also canceled the preventive detention of the woman, who had been detained since the time of the crime. According to the responsible judge, there is not enough evidence that Carla took the risk of killing the child, which rules out the thesis of a possible intention supported by the public prosecutor.
Consequently, the case for intentional homicide by omission was disqualified and removed from the jurisdiction of the Jury. The judge stressed that the totality of the evidence does not support a direct link between the mother’s behavior and the fatal outcome, although the prosecution said Carla failed to provide basic care, allowed the child to leave the house early in the morning and administered clonazepam without a prescription, factors which allegedly contributed to the death by asphyxiation. The report stated that Kerollyn died from mixed mechanical asphyxia, associated with confinement inside the container and the presence of the sedative in the body.
Despite the exclusion of homicide, Carla will continue to be responsible for four crimes of abuse against her children, the allegations of which include physical assault, deprivation of hygiene and food, lack of supervision and even exposure of the children to sexual content produced by herself. These processes remain ongoing in the ordinary courts. Carla will be able to respond freely, but must respect precautionary measures, such as periodic presence at the forum and prohibition of access to the residence where the crime took place.
Kerollyn’s father, Matheus Lacerda Ferreira, is also accused and responsible for material abandonment. According to the complaint, he had stopped providing for his daughter for at least two years, even after advice from the protection network and requests from the child herself to reestablish contact. Like Carla, Matheus responds freely to the matter, and the matter remains under investigation by authorities.
