
The Public Ministry of the Federal District and Territories (MPDFT) has proposed a Conduct Adjustment Condition (TAC) to a group of gas stations convicted of forming a cartel in the Brazilian capital.
Initially, the public prosecutor will propose a TAC for the condemned posts in order to repair the damage. The response time will be 15 days after notification.
In the event of delay or refusal, the MPDFT may initiate a Public Civil Action (ACP) with a request for double compensation.

This Wednesday (17/12), the MPDFT published in the Official Journal of the Union (DOU) the opening of a Public Civil Inquiry (PCI) to determine civil liability for collective moral and material damage.
After complaints and a long analysis process, the Administrative Council for Economic Defense (Cade) condemned a group of DF service stations for forming a cartel.
Cade condemned seven gas station networks operating in fuel resale markets in and around DF for forming a cartel. In total, the value of the fines imposed exceeds 154.5 million reais.
Established by the General Superintendency of Cade in 2020, the process began with a complaint filed by the Legislative Chamber (CLDF), which highlighted that some gas stations in the region were combining fuel prices.
Ten people held responsible face penalties that together exceed 5 million reais.
