The head of station number 3 of the civil and investigation section of the District Court of Villajoyosa (Alicante) decreed the provisional classification, due to the lack of a known perpetrator, of the case in which she was investigating the assassination of Maxim Kuzminov, … a helicopter pilot who deserted the Russian army.
The judge made this decision through an order that has already become final, after receiving a report from the Judicial Police of the Civil Guard in which it is reported that “it was not possible to specify the material or intellectual responsibility for the shots against the victim”.
The deceased, aged 33, died after receiving multiple gunshot wounds on February 13, 2024, in a residential complex near Rosa dels Vents Avenue in Villajoyosa. What began as a cold-blooded murder at the gates of a garage in a residential neighborhood gave rise to speculation that it was carrying out a “public vendetta” on the part of the Kremlin, which came to characterize it as “corpse of traitor, criminal and moral“.
The judicial body on duty that day opened preliminary proceedings to investigate the events, initially classified as a crime of homicide or murderand decreed the secrecy of the debates to protect the investigations.
However, the numerous investigative procedures carried out by the Homicide group of the Organic Unit of the Judicial Police of the Civil Guard have not made it possible to direct the case against one or more specific people as organizers or perpetrators of the crime.
“After analyzing the competing circumstances and taking into account the conditions that must be met for the commission of the criminal offense, this judge can conclude that there is insufficient evidence to attribute criminal responsibility to a determined person as author, accomplice or accomplice of the facts which gave rise to the formation of this case,” declares the instructor in an order dated last September. Thus, “the provisional classification of the procedure must be agreed in accordance with article 641.2 of the LECrim (Criminal Procedure Law)”, he concludes.
“Moral corpse”
As ABC reports, highly reliable sources close to the investigation have suggested that it may have been a crime sponsored by Russian intelligence services, a fact that has not been confirmed more than a year later, despite the fact that Kuzminov was publicly sentenced to death by the head of Russia’s foreign spy service. Sergei Narishkinwho described him as a “moral corpse”.
According to the same information published by this newspaper a few weeks after the crime, the hitmen reached the Russian deserter in part due to the notable number of reckless acts he had committed since his arrival in Alicante, where it was common for him to use drugs, resort to escort services and even participate in public altercations in a residential area where a large number of compatriots live. In addition, he regularly telephoned his country, in particular his girlfriend, whom he invited to travel and discover his new life.
For her part, the Minister of Defense, Margarita Robles, then stressed that the deserter “came freely to Spain” and that the executive of Pedro Sánchez was not aware of his alleged presence on the national territory. The Russian embassy in Madrid spoke similarly about the murder of the 33-year-old man found dead with several gunshot wounds in a garage in Villajoyosa.
