The deputy and former Secretary of Security of São Paulo, Guilherme Derrite (PP) spoke about the public security PEC prepared by the federal deputy Mendonça Filho (União Brasil). The measure includes, among other points, the possibility of reducing the age of criminal responsibility, to 16 years, for members of criminal organizations, such as CV and PCC.
According to Derrite, reducing the age of criminal responsibility constitutes necessary progress. “Lowering the age of criminal responsibility to 16 is important. And not just for people linked to organized crime. It’s a topic that needs to be discussed and has my support,” he told the Chronicle.

Derrite emphasized that the debate is not new in Congress. In 2015, the Chamber of Deputies approved the PEC which lowered the age of criminal responsibility, but the proposal ended up paralyzing in the Senate. The resumption of the debate, according to Derrite, constitutes an essential step towards the modernization of Brazilian criminal legislation.
The parliamentarian said he hoped the Public Security PEC would correct issues that he said represented “excessive centralization” of security policies within the federal government. “I emphasize that I have not yet read the entire text of the proposal by Mendonça Filho, who is very willing to report on this PEC, but what we need is coordination and integration, not centralization,” he said.
The proposal reported by Mendonça Filho also provides for the holding of a referendum so that the population can decide to reduce the age of criminal responsibility. Derrite agrees that this would be the most appropriate way to frame the question. “Issues of great importance must be submitted to popular consultation. I have no doubt that if they are submitted to a referendum, the reduction of the age of criminal responsibility will be approved,” he said.
