The Federal Police included a handwritten note on an “exchange” of municipalities in Ceará to receive parliamentary amendments as proof of the “detachment from formality” of the so-called “Secret Budget”, which was in force during the administration of the former President of the House, Arthur Lira (PP-AL). According to the PF, the note was seized from Mariângela Fialek, known as Tuca, former advisor to Lira, who was the target of search and seizure warrants this Friday. The MP is not in the sights of Operation Transparency.
Investigators pointed out that the distribution of the funds was ordered by Fialek, who was acting under orders from the then-House Speaker, and took place informally, like a “bakery bill.”
“In fact, one notices the unusual lack of attachment to formality in the preparation of the budget; a handwritten note, written in a rudimentary manner, was responsible for the reallocation of resources from one municipality to another. Unfortunately, it is impossible not to compare the way of controlling and organizing the secret budget coordinated by the TUCA to a ‘bakery account'”, affirms the representation of the PF, cited in a decision by the Minister of the Federal Supreme Court, Flávio Dino, responsible for the Cut folder.
“The note shows that millions of public resources were directed on the basis of verbal orders, without any concern for real republican projects or interests,” concluded the PF.
According to investigators, this note constitutes a “clear indication” that the former advisor was responsible for “the organization of the secret budget”.

When contacted, MP Júnior Mano said that it was the responsibility of the parliamentarian to indicate the amendments and that everything was done within the limits of regularity.
— Is it prohibited to indicate an amendment? — he asked.
Informed that, in the decision, the minister describes the paper seized as a “bakery bill”, indicating that the indication of amendments must follow formal procedures, the deputy simply declared:
— So let him say it — added Mano, affirming that he would not comment further on the minister’s decision.
In addition to the manuscript, the PF collected statements from 4 deputies and a senator according to which the allocation of amendments was not discussed or deliberated within the committees, but concentrated in a parallel body, linked to the presidency of the House.
According to certain information, the lists of applications arrived ready-made to the presidents of the collegial bodies, without identification of the author, the subject or the beneficiaries, the commissions only being responsible for formalizing the referrals already defined.
The federal police executed two search and seizure warrants, at the address of the parliamentary advisor in Brasilia and in a room of the Chamber of Deputies.
In an opinion, the Public Prosecutor’s Office defended the precautionary measures against Fialek, saying that the representation is “embodied by significant elements”, including police statements and analyzes that suggest his unlawful action in controlling indications of deviated amendments.
According to the Attorney General of the Republic, Paulo Gonet, Fialek “seems to exercise control over the deviations from the amendments resulting from the secret budget” in favor of a criminal organization focused on the commission of functional deviations and crimes against the public administration and the national financial system.
