An order signed by the former judge of the 13th Federal Court of Curitiba (PR), now Senator Sergio Moro (União-PR), would be documentary proof that he irregularly ordered authorities with privileged jurisdiction to be wiretapped. The document was discovered during a search and seizure operation carried out by the Federal Police (PF) in this federal justice unit and proves, in theory, the surveillance orders.
The order, dated July 2005, was published in the column of journalist Daniela Lima, of Uol. In the text, Moro demands that a court collaborator, former state deputy Tony Garcia, make a new recording of the president of the State Court of Auditors (TCE-PR), Heinz Herwig.

Along with the document, the PF also found the entire 40-minute recording of which Herwig was the target. The second telephone tapping of the TCE-PR cfefe would have been ordered because Moro considered the previous recordings to be “unsatisfactory with regard to the objectives sought”.

Pre-Lava Jato case
The PF operation at the 13th Court, carried out on the 3rd, was authorized by Minister Dias Toffoli, of the Supreme Federal Court (STF). This decision responded to repeated requests by the STF for documents related to the pre-Lava Jato investigations to be sent to the Court by the Federal Court of Paraná.
Among the data sought is information on the case of businessman Tony Garcia, who served as an informant in the investigations carried out by the Tribunal then headed by Moro.
At the time, Garcia collaborated in the investigations, registering, at the request of the Federal Court, the competent authorities by prerogative of office, including Herwig.
Thanks to this operation, the STF finally had access to all the documents and files which, according to the court, should have been sent months ago for analysis.
Toffoli’s decision was based on evidence of repeated non-compliance with court decisions, which prevents the advancement of investigations opened at the Supreme Court into possible irregularities in the conduct of pre-Lava Jato cases.
Intelligence reports
The material seized by the PF, which includes intelligence reports, exposes the transcription of wiretapping carried out on TRF-4 judges and politicians with privileged jurisdiction. This would corroborate allegations from several whistleblowers that the judge at the time used them to surveil authorities outside their legal reach.
Herwig’s recording took place in February 2005. Five months later, Moro ordered whistleblower Tony Garcia to repeat the wiretapping attempt.
The PF also seized recordings of wiretapping of judges who were then part of the Federal Regional Court of the 4th Region (TRF-4), responsible for reviewing the decisions of the Federal Court of Paraná.
These phone taps were carried out by another Lava Jato collaborator, lawyer Sérgio Renato da Costa. As in the case of the president of the TCE, magistrates benefiting from this prerogative could only be the subject of an investigation by decision of the Superior Court of Justice (STJ).
The other side
According to Uol, Moro was approached to give his version of the facts. The senator denied the allegations and said they were based on fanciful accounts of convicted criminals.
