
A statement attached to the representation of the Federal Police at the Supreme Federal Court (STF) highlights that the office of federal judge Macário Ramos Judice Neto, of the Federal Regional Court of the 2nd Region (TRF-2), had prior knowledge of the date of a police operation against also the state deputy TH Jóias, due to his relationship with the Comando Vermelho. The judge was the target of a PF operation launched this Tuesday.
In a statement to the PF as part of this investigation, the delegate who worked on the file said he informed the magistrate’s office, on the morning of September 2, that the intention was to execute the arrest warrants for the operation against TH Jóias early in the morning of the next day, September 3. The contact took place at 10:49 a.m., via a message sent to the advisor identified as Marcelo, according to the formal report provided to the PF.
In the press release, the delegate specifies that the advisor responded by assuring that the warrants would be issued that day. A few minutes later, at 11:16 a.m., Marcelo sent an audio whose transcription was included in the official investigation document. In the voice message, the advisor indicates that he has just arrived at the court and that he would speak directly to the rapporteur’s office.
For the Federal Police, the contact record demonstrates that the start date of the operation was already known in advance within the rapporteur’s advisory team, which, although described as something “natural” in large-scale investigations, ended up revealing a point of vulnerability in the execution of due diligence.
“The prior knowledge of the judge, which seems natural, especially in an investigation of this magnitude, actually revealed a possible vulnerability in the successful execution of the orders issued by him. In fact, as can be seen in the statements of RODRIGO BACELLAR, more precisely from 8:40 a.m., the parliamentarian declares having spoken with TH JOIAS about the alleged police operation around 11:00 a.m. that same day of 02/9/2025, inside the Tiradentes Palace. In other words: just after the Federal Police communicated to the Judge’s Office the date set for the explosion”, says the PF in the representation sent to the Supreme Court.
In the same representation, the PF reconstructs the complete history of the file after this formal contact. According to investigators, on the night of September 2, a few hours after exchanging messages with TRF-2 advisors, the president of the Legislative Assembly of Rio de Janeiro (Alerj), Rodrigo Bacellar, was face-to-face with Judge Macário Judice Neto at the Assador restaurant, in Aterro do Flamengo.
Messages extracted from chat applications indicate that Bacellar informed his interlocutors that he was there accompanied by “Macário” and a “judge”. For the PF, the meeting took place on the eve of the launch of the operation and at the very time when one of the people indicted was exchanging messages relating to the removal of goods and possible avoidance measures.
The representation also highlights that Bacellar, in addition to being president of Alerj, maintained direct dialogue with the targets of the investigation, including providing advice on travel and logistical arrangements after information about the operation was released.
