PL Antifaction: The rapporteur meets with the government and cancels Derit’s changes

The rapporteur of Bill No. 5,582/2025, known as “PL Antifaction”, Senator Alessandro Vieira (MDB-SE), presented this Wednesday (3/12), an alternative to the text that resumes the creation of the criminal faction of the criminal type and equates the militias with these crimes. This proposal is on the agenda of the Senate Constitution and Justice Committee.

Vieira responded to a large part of the demands of the government of President Luiz Inacio Lula da Silva (PT) – author of the project that was the subject of debate in the Chamber of Deputies under the supervision of former São Paulo Public Security Secretary Guilherme Dirit (PP-SP).

In addition to providing treatment to criminal factions, which can lead to sentences ranging from 15 to 30 years in prison, the senator from Sergipe has incorporated security measures stipulated by the government. Vieira also removed the ban on granting incarceration assistance and voting restrictions to prisoners for these crimes. The rapporteur considered both devices unconstitutional.

On the other hand, he also nodded to the chamber praising the Dirit report and the tougher penalties for crimes such as murder, threats, extortion and embezzlement – when committed by faction members. He also maintained his determination that the evolution of the system would have stricter rules for faction members.

These resources will be separate from the National Public Security Fund and will come from the creation of a new tax on online betting houses – Bets. The total resources, according to the Central Bank’s projections, should reach R$30 billion annually.

“We understand that the main factor that can change the country’s public security and the fight against organized crime is the allocation of budget resources. With the increased penalties and tougher enforcement measures provided for in this project, we know that the prison system, which is already suffering from overcrowding, will be even more demanding,” says the rapporteur.
