Barcelona, 12. December (EFE). – A court in Reus (Tarragona) has ordered a provisional prison sentence with notice and without bail for the man arrested last September as the alleged perpetrator of the murder of his partner in Riudecanyes.
At around 10:30 a.m. on September 8, the police received news of the discovery of the body of a woman with signs of violence, which was found in the Gendre Gorge near the T-313 highway.
Following police investigations, the Mossos d’Esquadra arrested this 45-year-old man in Reus on December 10th as the suspected perpetrator of the murder of his 36-year-old partner.
After being brought to trial, the Investigative Court 3 of Reus ordered this measure of deprivation of liberty for the prisoner and withdrew in favor of the Violence Against Women Court of Reus to continue the proceedings in this case of sexist violence.
In his arrest warrant, the judge invokes the risk of escape in order to send the prisoner to prison given the seriousness of the crime he is accused of – premeditated murder/murder – with penalties exceeding two years in prison.
In addition, it points out that, given the ties of the detainee, a Moroccan citizen, to his country, there are not enough roots in our country to prevent him from evading the activity of justice and that he does not have “significant” ties of a labor or economic nature, all of which increase the “very significant risk of flight in the face of such a high sentence as can be demanded for these events”.
In this sense, the judge added: “There is no other less burdensome and equally effective measure to achieve these objectives by which provisional detention can be avoided.”
The judge’s order, as a result of police investigations, contains a series of evidence that holds the man responsible for his wife’s death.
It said that after his arrest and during the inspection of his vehicle, samples were taken that, in the absence of subsequent analysis, “could be the victim’s blood and would be consistent with the fact that he took the woman in the vehicle to the location where the body appeared.”
The judge emphasized that after his arrest the man exercised his right not to testify without offering a “reasonable explanation or justification for the facts and the incriminating elements presented to him.”
In addition, the Mossos emphasize in their report that between 07:00 and 07:57:16 there was an “apparent compatibility of the presence of the subscriber number” of the alleged perpetrator’s cell phone in both the city center of Riudecanyes and in the Gendre Gorge.
However, it is further noted that as of 07:57 a.m., the time at which she is estimated to have been murdered, only the area where the woman’s body appeared was affected, so in no case could her cell phone be located in the Riudecanyes urban area at that time.
The order also notes inconsistencies between the statements the man made at the time after his wife’s body was discovered and the evidence obtained by the police.
In this sense, the man explained twice that he had gone to a municipal cleaning point in Riudecanyes when his wife disappeared, something that is disputed by the images from the cameras stationed in the area.
In the car there are also statements from the victim’s family, such as those from her own daughter, who explained to her aunt that her father left the house just a few minutes after her mother and that she returned shortly afterwards with different clothes than the ones she was wearing when she left.
Police evidence also included draining the victim’s cell phone, and in some messages she accused her husband of failing to find a suitable rental apartment and of “sleeping all day,” “even” telling him as an “ultimatum” that she would “leave alone if necessary.”
In fact, relatives of the victim told the police that the couple was living poorly in an apartment with their four underage children and that they were having financial problems. EFE
