São Paulo’s Procon company, linked to the City Council, sent a notice last Friday (28) to Latin America requesting clarification on the construction of “premium” bathrooms, which can only be used by passengers in the first rows or higher class.
The airline’s action sparked a strong reaction on social media and could be described as offensive, Procon says in the notice.
Moreover, according to the organization, the initiative was announced in conjunction with the creation of a new category of seats granting the right to use the bathroom.
This fact, according to the notice, “reinforces the association between restricting bathroom use and providing premium service for an additional fee.”
“Such a practice may constitute a violation of the principles of dignity, equality and autonomy, as well as the right to adequate services,” Brocon adds.
The agency gave a period of ten calendar days for the company to provide justification for the restriction and communicate how it would communicate it to consumers.
Procon warns that if the notification is not complied with within the deadline, penalties stipulated in the Consumer Protection Law may apply, such as fines, temporary suspension of activity, revocation of the license and other penalties.
LATAM stated, in a statement, that it would provide the necessary clarifications.
