The two Supreme Court judges Ana Ferrer and Susana Polo expressed two dissenting votes on the sentence of the former state attorney general, Álvaro García Ortiz. The judges consider that it is not proven that Álvaro García Ortiz “or his entourage” disclosed the email in which the defense of Isabel Díaz Ayuso’s partner recognized tax fraud. They also do not consider it a crime to issue a press release seeking to deny information about the case that is “not true.”
The judgment of the Supreme Court that condemns García Ortiz considers it proven that the attorney general of the time “or one of his relatives” leaked to the press the confession of tax fraud of Isabel Díaz Ayuso’s partner on the night of March 13, 2024. The judgment understands that the prosecutor’s statement on the case also revealed confidential data and that “the state attorney general cannot respond to false news by committing a crime.”
