
The Senate plenary approved, on Tuesday evening (16), a bill that authorizes the retroactive payment of benefits frozen due to the covid-19 pandemic to employees of states, municipalities and the Federal District. The text is transmitted to President Luiz Inácio Lula da Silva (PT) for sanction.
Benefits – such as annual, three-year, five-year leave and bonus – are those that should have been paid between May 28, 2020 and December 31, 2021. To be able to carry out this operation, however, the State, municipality or Federal District must have declared a public calamity during the pandemic and have budgetary resources to carry it out.
According to the rapporteur, Senator Flávio Arns (PSB-PR), this affair does not generate any fiscal impact and, even less, any compulsory or automatic expenditure for the federative entities.
“By linking any retroactive payment to the entity’s own budgetary capacity, the text avoids an artificial increase in expenditure and prevents burdens from being unduly transferred to the Union or other entities, thus preserving fiscal transparency and legal certainty,” Arns said.
This proposal is one of several proposals added to this Tuesday’s agenda as part of an effort by the President of the Senate, Davi Alcolumbre (União-AP), to vote on issues of interest to senators and that reach consensus before the start of the legislative recess, on the 23rd.
